to the processing of personal data
on the Doctor Stroy digital platform

This Consent is a standalone document and is provided by a separate checkbox that is not combined with the acceptance of the Terms of Use or other documents, as required by part 1 of Article 9 of Federal Law No. 152-FZ of 27 July 2006 «On Personal Data» (the «Law No. 152-FZ»).
1. GENERAL PROVISIONS. PROCEDURE FOR PROVIDING CONSENT
1.1. I, a legally capable natural person, at least 18 years old, who am registered or going through registration on the Doctor Stroy digital platform (the «Subject», «I»), of my own free will and in my own interest, give my consent to the Operator specified in Section 2 to process my personal data on the terms set out in this Consent.
1.2. This Consent is provided in the form of an electronic document by ticking the checkbox next to the text «I consent to the processing of my personal data» and by the subsequent completion of the registration action. The ticking of the checkbox and the performance of the said action are, in accordance with Article 6 of Federal Law No. 63-FZ of 6 April 2011 «On Electronic Signature», recognised as a simple electronic signature of the Subject and equivalent to a handwritten signature.
1.3. The Subject who has provided the Consent is identified by the combination of data provided by the Subject in the registration form (surname, first name, patronymic (if any), mobile phone number, email address) and by the date, time and technical parameters of the provision of the consent, which are recorded and stored by the Operator. The Operator stores information on the fact, date and content of the consent provided.
1.4. The Consent is specific, substantive, informed, conscious and unambiguous. Provision of this Consent is voluntary. Certain functions of the Platform, for which the processing of the relevant personal data is necessary, may not be available if the Consent is not provided or is withdrawn.
2. OPERATOR RECEIVING THE CONSENT
2.1. The Consent is provided to the Operator: Individual Entrepreneur Malshaev Baatr Anatolyevich, OGRNIP 321080000003188, INN 081400461200, address: 358014, Republic of Kalmykia, Elista, Citi-3 microdistrict, building 34, email: malshaev@yandex.ru, phone: +7 909 399-93-42.
2.2. The procedure for the processing of personal data by the Operator is determined by the Privacy Policy posted at doctorstroy.ru/legal/privacy (the «Policy»). This Consent is given on the terms harmonised with the Policy.
3. LIST OF PERSONAL DATA TO WHICH CONSENT IS GIVEN
3.1. I consent to the processing of the following of my personal data (general part — for all Users):
- surname, first name, patronymic (if any) or a name indicated by me;
- date of birth;
- mobile phone number;
- email address;
- postal address and/or address of the place of service provision;
- information on the chosen city of presence or service provision;
- profile photograph (avatar);
- information on preferences and convenient time for contact;
- free-form text information provided by me personally (comments, descriptions of requests, chat messages, reviews and ratings);
- data on the Account and authentication: Account identifier, information on phone and email verification, timestamps of document acceptance and login, technical session identifiers;
- data on interaction with the Platform: history of requests, orders and rentals, history of correspondence and notifications;
- technical data: device network address (IP address), browser and operating system information (User-Agent), device token for push notifications, device platform information;
- geographic coordinates of the device — processed only upon my request at the moment of city determination or address selection;
- diagnostic information on crashes and stability of the mobile application (crash stack, application and OS version, device model, anonymised installation identifier) — used exclusively for diagnostics.
3.2. Additional list for Service Providers
If I register or act on the Platform as a Service Provider (self-employed, individual entrepreneur or other service provider), I additionally consent to the processing of the following personal data:
- series and number of the identity document; photo- and scan-copies of such document;
- taxpayer identification number (INN);
- information on the form of employment and tax status;
- professional information: specialisation, experience, description of services, portfolio of works (photographs);
- information on tariffs and availability schedule;
- bank details — if settlements need to be performed.
3.3. I confirm that special categories and biometric personal data are not provided by me within the scope of this Consent and are not processed by the Operator for these purposes. If free-form text information, photographs or files I provide contain personal data of other natural persons, I confirm that I have a lawful basis for transferring them to the Operator and bear liability for the lawfulness of such transfer.
4. PURPOSES OF PROCESSING OF PERSONAL DATA
4.1. I consent to the processing of my personal data for the following purposes:
- registration and identification on the Platform, provision of access to the Personal Account;
- authentication, maintenance of sessions and ensuring information security;
- operation of the Platform and provision of its functionality, including posting and search of information, submission and processing of Requests, organisation of correspondence between Users;
- conclusion and performance of Transactions, processing of requests, orders and equipment rental contracts arranged by Users between themselves with the assistance of the Platform;
- identification of the Service Provider for settlements and compliance with tax law (for Service Providers);
- service messages on the status of requests, orders and rentals, sending of confirmation codes, access-recovery links and other service messages via SMS, email and push notifications;
- handling of inquiries, requests and claims, user support;
- audit logs and investigation of information security incidents;
- accounting and tax records, performance of obligations of the Operator under the legislation of the Russian Federation, including responses to requests of state authorities;
- improvement of the Platform and generation of anonymised statistics.
4.2. Consent to the processing of personal data for the purposes of marketing (advertising) communications is not covered by this Consent and is provided by a separate document — the Consent to Receive Marketing and Information Communications. Consent to the processing of personal data permitted for distribution (public profile, portfolio, reviews) is also provided by a separate document — the Consent to the Processing of Personal Data Permitted for Distribution.
5. ACTIONS AND METHODS OF PROCESSING
5.1. I consent to the Operator performing the following actions (operations) with my personal data: collection, recording, systematisation, accumulation, storage, refinement (update, modification), extraction, use, transfer (provision, access), anonymisation, blocking, deletion and destruction.
5.2. The processing is carried out by mixed methods — using means of automation and without using such means.
5.3. The recording, systematisation, accumulation, storage, refinement and extraction of my personal data are carried out using databases located on the territory of the Russian Federation.
6. PARTIES ENTRUSTED WITH PROCESSING
6.1. I consent to the Operator entrusting the processing of my personal data to the parties listed below on the basis of agreements concluded with them (part 3 of Article 6 of Law No. 152-FZ), in the scope and for the purposes necessary for the operation of the Platform:
6.2. I also consent to the transfer of my personal data to the Operator's franchisee Partners to the extent necessary for the performance of my request or order (name, contact phone, address of visit, composition and content of the request), for the purpose of performing the relevant Transaction.
6.3. The list of parties entrusted with processing may be updated by the Operator; the current list with addresses is set out in the Policy at doctorstroy.ru/legal/privacy. Engaged parties are required to observe confidentiality and ensure the security of personal data.
7. CONSENT TO CROSS-BORDER TRANSFER OF PERSONAL DATA
7.1. By this Section, I provide my separate consent to the cross-border transfer of part of my personal data on the terms of Article 12 of Law No. 152-FZ. The transfer is to a single recipient — Google LLC (United States of America) — in two directions described in the table below.
7.2. I am informed that cross-border transfer to a state not providing adequate protection of personal data subjects' rights is associated with additional risks, and I confirm that I give this consent consciously for both directions.
7.3. The Operator does not carry out any other cross-border transfers of my personal data. Consent to cross-border transfer may be withdrawn separately from the remaining part of this Consent in the manner provided for in Section 9; withdrawal of consent to cross-border transfer results in the termination of the use of the relevant services in the part related to the processing of my personal data.
This Section applies where the Operator uses the Firebase services (Cloud Messaging and Crashlytics). If the Operator switches to Russian alternatives, the cross-border transfer terminates and the Operator informs of this in the Policy.
8. VALIDITY OF CONSENT
8.1. This Consent is valid from the moment of its provision and for the entire period necessary to achieve the purposes of processing specified in Section 4.
8.2. The Consent is valid until its withdrawal by the Subject. In case of withdrawal of the Consent, the Operator may continue processing of personal data without the Subject's consent where there are grounds provided for in clauses 2–11 of part 1 of Article 6, part 2 of Article 10 and part 2 of Article 11 of Law No. 152-FZ (in particular, for performance of an agreement to which the Subject is a party; for performance of obligations imposed on the Operator by law; for protection of the rights and legitimate interests of the Operator).
8.3. Upon achievement of the purposes of processing or upon withdrawal of the Consent in the absence of other legal grounds, personal data are subject to destruction or anonymisation within the periods established by Law No. 152-FZ and the Policy. Information on the fact and conditions of the consent provided is kept by the Operator for at least 3 years after termination of processing.
9. PROCEDURE FOR WITHDRAWAL OF CONSENT
9.1. I may withdraw this Consent in whole or in part (including separately in the part of cross-border transfer) at any time.
9.2. Withdrawal of the Consent is carried out by sending to the Operator a written application (in free form, indicating the data identifying the Subject) at the address 358014, Republic of Kalmykia, Elista, Citi-3 microdistrict, building 34 or by email at malshaev@yandex.ru, or using the relevant functionality of the Personal Account (where available).
9.3. The Operator terminates the processing of personal data and ensures their destruction (anonymisation) within no more than 30 days from receipt of the withdrawal, except where processing may be continued in accordance with clause 8.2 of this Consent.
10. CONFIRMATIONS BY THE SUBJECT
10.1. By providing this Consent, I confirm that:
- I have reached the age of 18 and have full legal capacity;
- I have read this Consent and the Privacy Policy, I understand their content, and my rights as a subject of personal data under Law No. 152-FZ have been explained to me;
- the personal data I have provided are accurate and relate to me (and, in the part of third-party data, are transferred by me on a lawful basis);
- this Consent is provided by me freely, of my own will and in my own interest, by a separate checkbox not combined with the acceptance of other documents.
10.2. The text of this Consent, the date and time of its provision and the data identifying the Subject are kept by the Operator and may be provided to the Subject upon their request sent in accordance with clause 9.2.
